READ THESE TERMS AND CONDITIONS CAREFULLY.
YOUR USE OF THIS SITE AND/OR ANY INTERNET SPORTS TRAVEL, INC. (‘IST’) SERVICE
SHALL MEAN THAT YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS HEREIN.
IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS, DO NOT
USE THIS WEBSITE AND DO NOT UTILIZE THE SERVICES OFFERED BY IST.
For purposes herein, ‘you’ or ‘your’ shall
be any person accessing this website or utilizing any of the services
offered by IST including the parent(s) or legal guardian(s) of a minor who
utilizes the services of IST for the benefit of such minor. IST now gives
notice that it reserves the right to change or modify any or all of these
terms and conditions at its sole discretion and without further notice to
you. PRICING PROVIDED ON THIS SITE IS SUBJECT TO CHANGE. Your continued
use of this website and/or IST services shall mean that you accept any and
all changes and modifications. It is your sole responsibility to inform
the Sports Camp participant and any traveling companions of these terms
and conditions as you shall indemnify IST from claims and actions which
arise from each such person that they were not made aware of these terms
and conditions of use.
1. IST.
IST serves as a consultant and intermediary
between you and various independently owned and operated sports camps
located in Europe and the United States of America (‘Sports Camps’) for
which IST charges you a non-refundable fee. IST visits many Sports Camps
each year to meet the staff and operators of the Sports Camps, inspect the
accommodations and menus, review the sports programs, and gain knowledge
of the various offerings. IST consulting services are to assist you in
determining which Sports Camp has the program offerings you are interested
in and to assist you with the Sports Camp registration. IST HAS NO
AUTHORITY OR CONTROL OVER THE OPERATION OR POLICIES OF THE SPORTS CAMPS.
In the event you are not satisfied with a Sports Camp, you shall look
solely to the Sports Camp for rectification and shall hold IST harmless
and not responsible for any and all expected or unexpected, known or
unknown incurred injuries, damages, losses or inconveniences caused to
you. EACH SPORTS CAMP SHALL SET IT’S OWN POLICY REGARDING REFUNDS AND
CANCELLATIONS. IST is not responsible for refunds of any money due to you
by Sports Camp or for increased charges by Sports Camps. However,
any refunds due to you which are received by IST will be promptly
forwarded to you less IST service fees.
2. SPORTS
CAMPS. YOU ARE HEREBY GIVEN NOTICE THAT
EACH SPORTS CAMP SETS ITS’ OWN TERMS AND CONDITIONS, PROCEDURES AND
POLICIES INCLUDING THOSE FOR CANCELLATION AND/OR REFUND. Though not all
Sports Camps have written terms and conditions, when such are available
such will be provided as part of your registration/application
information. If you have any questions regarding a Sports Camp policies
or procedures, contact IST in writing via email or at the address provided
in the registration confirmation, with any questions prior to reserving a
place in a Sports Camp. YOU ARE HEREBY GIVEN NOTICE THAT CERTAIN SPORTS
CAMPS, DEPENDENT ON A MINIMUM NUMBER OF PARTICIPANTS ATTENDING EACH
SESSION, HAVE CANCELLATION POLICIES FOR INSUFFICIENT ENROLLMENT WHICH MAY
INCLUDE OFFERING YOU ALTERNATIVE SESSION DATES OR GEOGRAPHICAL SPORT CAMP
LOCATIONS OR A REFUND OF THE SPORTS CAMP FEE. Cancellation and refund
policies specific to your chosen Sports Camp will be provided in the
registration confirmation. You are strongly encouraged to obtain insurance
which may cover your costs in case of cancellation by you or the Sports
Camp. Each Sports Camp reserves the right to terminate, without refund of
any sort, the enrollment of any participant who: behaves in a manner which
is disruptive or dangerous or in breach of any applicable local laws; or
appears unfit to attend by virtue of incapacity through drugs or alcohol.
Each Sports Camp retains the right to use any photographs, videotapes,
motion picture recording or any other record of the event for publicity,
advertising or any legitimate purpose. Authority to Register and/or to Act
as Agent: You represent and warrant to Internet Sports Travel, Inc.
("IST") that you have full legal authority to complete this event
registration, including full authority to make use of the credit or debit
card to which registration fees will be charged. In addition, if you are
registering third parties, you represent and warrant that you have been
duly authorized to act as agent on behalf of such parties in performing
this event registration. By proceeding with this event registration, you
agree that the terms of this Registration Agreement shall apply equally to
you and to any third parties for whom you are acting as agent. Compliance
with Children's Online Privacy Protection Act (COPPA). You represent and
warrant that, in compliance with COPPA, you are over thirteen (13) years
of age, and that if you are registering a child under fourteen (14) years
of age you are the parent of such child, and do hereby consent to the
collection of such child's personal information by IST.
3. FEES;
CREDIT CARD AUTHORIZATION.
You are solely responsible for your airfare, ground transportation, Sports
Camp fees, and other travel expenses including insurance. To lock in a
Sports Camp fee price and reserve a place in a Sports Camp, you shall
provide IST with a deposit amount (each camp has a different amount) (part
of which is a non-refundable reservation deposit) and an electronically or
physically signed registration/application. All monies are in United
States currency. It is your sole responsibility to contact IST in writing
via email or at the address provided in the registration package, with
any questions prior to reserving a place in a
Sports Camp. The remaining balance must be received by IST as follows: if
your program begins in April, all balances are due February 1.
If your program begins in June or July, all balances are due May 1. If
your program begins in August, all
balances are due June 1; or without further
notice to you, your reservation will be cancelled and the reservation
deposit will be forfeit. For bookings made after May 1 for June and
July camps, full payment is requested on booking.
For bookings made after June 1 for August camps, full payment
is requested on booking. Further, you agree your credit card number will be made directly
available to the Sports Camp in the following additional circumstances: i)
For your Sport Camp participant’s (‘camper’) necessary medical care should
such be required during the Sports Camp session and/or ii) For any damage
to Sports Camp property caused by your camper.
4. INSURANCE.
IST strongly recommends the purchase
of insurance coverage for travel, cancellation, medical and personal
property for all travelers from a broker of your choice.
You acknowledge that it is your responsibility to understand the
limitations of your insurance coverage and you agree that IST is in no way
responsible for any losses not covered by the insurance policy. IST is not
responsible for underwriting decisions on claims made by you to the
insurance company.
5. USAGE; COPYRIGHT.
i) This site contains links to other
websites for which IST assumes no responsibility for the content found
therein. IST's inclusion of such links to third party sites, for which
IST may receive remuneration, does not imply any endorsement of the
material or product offered therein. ii) By utilizing the services
offered at this website you represent that you are of sufficient legal age
to utilize IST services and to create a binding legal obligation for any
liability you may incur as a result of such usage. Those under the age of
18 must ask their parent or guardian for permission before using this site
or sending any personal information over the Internet. iii) This site
may not be used to make any false or fraudulent reservations. iv) You
warrant to IST that you will not use this site nor IST services for any
purpose that is unlawful or prohibited. v) This site is provided on an
'as is' and 'as available' basis without warranty that this site is free
from infection by viruses or contaminating or destructive properties. You
(and not IST) assume the entire cost of any servicing, repair, or
correction needed from use of this site. vi) This site is accessible
from all fifty (50) states and countries worldwide. You are responsible
for compliance with local laws, if and to the extent local laws are
applicable for such access. vii) This site is protected by the copyrighted
laws of the United States, international treaties, patent, trademarks laws
and other intellectual property laws. IST owns (or licenses) the logo,
design, all the wallpaper, icons, characters, artwork, images, graphics,
music, text, software, and other content on this site. You may not
reproduce, copy, or redistribute the design or layout of the IST website,
individual elements of the website design without the express written
permission of IST. All rights reserved.
6. TRAVEL CONSUMER RESTITUTION
CORPORATION. IST is a
participant in the Travel Consumer Restitution Corporation (TCRC). For
travelers located within California at the time of purchase of certain
travel, the following notice is hereby given: “You, the traveler, may
request reimbursement from TCRC if you are owed a refund in a timely
manner by a seller of travel who was registered and participating in the
TCRC at the time of sale. The maximum amount which may be paid by the TCRC
to any one passenger is the total amount paid on behalf of the passenger
to the seller of travel, not to exceed US$15,000.00 A claim must be
submitted to the TCRC within six months after the scheduled completion
date of the travel. A claim must include sufficient information and
documentation to prove your claim and a US$35.00 processing fee. You must
agree to waive your right to other civil remedies against a registered
participating seller of travel for matters arising out of a sale for which
you file a claim with the TCRC, if you were located in California at the
time of sale. You may request a claim form by writing to: Travel Consumer
Restitution Corporation, P.O. Box 6001, Larkspur, CA 94977-6001; or by
faxing a request to: (415) 927-7698. For travelers located outside
California at the time of purchase: This transaction is not covered by the
California Travel Consumer Restitution Corporation. State of California

travel does not constitute approval by the State of California.”
7. DISCLAIMER OF WARRANTY.
TO THE FULLEST EXTENT PERMITTED BY LAW,
IST DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND
(EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO
THE WARRANTIES OF MERCHANTABILITY, DURABILITY AND FITNESS FOR A PARTICULAR
PURPOSE, QUALITY, SATISFACTORY QUALITY) INCLUDING WITHOUT LIMITATION, IN
REFERENCE TO THE SERVICES, ALL INFORMATION, PRODUCTS AND OTHER CONTENT
INCLUDED IN OR ACCESSIBLE FROM THE SITE.
8. LIMITATION OF LIABILITY.
IN NO EVENT WILL IST BE LIABLE FOR ANY
DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT
LIMITATION THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS AND/OR SERVICES,
ARISING OUT OF YOUR USE OF IST SERVICES AND/OR WEBSITE EVEN IF IST HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, YOU HEREBY
AGREE TO INDEMNIFY IST FROM ANY CLAIM ARISING FROM THE PROVISION OF
SERVICES BY IST TO YOU UNDER THIS AGREEMENT. SOME STATES DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND
EXCLUSIONS MAY NOT APPLY TO YOU. HOWEVER, IF DESPITE THE EXCLUSIONS
CONTAINED IN THIS CLAUSE, IST SHOULD BE FOUND LIABLE IN A COURT
OF COMPETENT JURISDICTION AS PERMITTED HEREIN, IN NO EVENT SHALL IST's
TOTAL LIABILITY FOR ANY AND ALL DAMAGES, LOSSES, AND CAUSES OF ACTION
(WHETHER IN CONTRACT OR TORT INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) TO
YOU EXCEED THE AMOUNT RECEIVED BY IST IN CONSULTING FEES, IF ANY, FOR THE
BOOKING OF YOUR SPECIFIC IST SERVICE.
9. HOLD HARMLESS.
You shall hold IST not responsible for and
harmless from: i) any omissions, errors, or acts committed by any Sports
Camp including failure to comply with any/all domestic and/or
international laws, breach of contract, failure to provide paid-for
reservations, intentional or unintentional actions or omissions that
result in but are not limited to loss/damage/delay/ inconvenience/injury
to you, which includes those traveling with you; ii) for the insolvency,
receivership, bankruptcy, liquidation, or similar financial condition
(known or unknown) of any Sports Camp; iii) for any credit card
unauthorized use or fraudulent, unscrupulous acts committed by any Sports
Camp, or persons as the result of your credit card information made
available by IST to a Sports Camp hereunder.
10. LEGAL. In
the event of any inconsistency between these IST terms and conditions and
the terms and conditions of the specific sports camp, with respect to IST
services, these terms and conditions shall govern. Use of the site
and/or IST services shall be governed by and construed in accordance with
the laws of the State of California, USA, without giving effect to any
principles of conflicts of law. Any dispute arising from or related to
this site or IST services will be heard by the appropriate federal and/or
state courts located in Santa Clara County, California, USA, and you
hereby consent and submit to the personal jurisdiction of such courts for
the purposes of litigating any such action. If the court’s decision falls
in favor of IST, all legal costs will be paid by disputer.

Following are some very useful safety tips and suggestions
for travelers during this time of uncertainties and wars:

Charge it.
Under the Fair Credit Billing Act, credit card customers have the right
to refuse paying for charges for services not rendered, such as a cancelled
flight, giving travelers some peace of mind. Details can be found at the
Federal Trade Commission’s Web site at
www.ftc.gov/bcp/conline/pubs/credit/fcb.htm.

Purchase travel insurance. Some travel insurance policies
may offer varying degrees of protection during a military conflict. Consumers
should check with your travel agent to determine what policy best meets their
needs.
·
Stay connected. Leave your e-mail address with your travel
agent so that they may pass along whatever knowledge they have of the situation.
Also, get the address and telephone number of the U.S. embassy or consulate for
each country. In case of difficulties, contact U.S. authorities promptly.
·
Paper tickets or e-tickets? Travelers should discuss with
their travel agents the pros and cons of paper tickets and e-tickets. While
airlines typically charge fees for paper tickets (around $25), they are more
easily transferred to another airline for rebooking in the event your original
airline isn't flying. On the other hand, with e-tickets, travelers can often
avoid long check-in lines at airports. Talk to your travel agent to decide
what’s best for you.

Transportation Security Administration. This site
www.tsa.gov gives travel tips, information on
security procedures, lists of what you can bring with you on flights, latest
news, etc.
·
U.S. Customs Service. Visitors to
www.customs.gov will find regulations and information related to leaving and
entering the United States.
·
U.S. State Department. Get travel updates via the U.S.
State Department at
http://travel.state.gov for up-to-the-minute information, including any
worldwide alert or advisories.
At the airport …
·
Allow extra time. Arrive at the airport two hours early.
·
Ask your travel agent. Check with your travel agent to
regarding any changes in airport security procedures, e.g. has curbside check-in
been temporarily discontinued.
·
Keep your I.D. handy. You may be asked after entering the
gate area to produce a picture I.D. such as a driver’s license, passport, or
government-issued identification for airport or airline personnel. Make your
reservation in the exact name that appears on the identification you plan on
presenting at the airport. If your name has recently changed and the name on
your ticket and your I.D. are different, bring documentation of the change
(e.g., a marriage certificate or court order).
·
Get a boarding pass. At many terminals, passengers now are
required to present both a boarding pass and government-issued photo ID
to pass through the security checkpoints. Tickets, itineraries and e-ticket
receipts are not sufficient. Boarding passes can be obtained at airline ticket
or curbside check-in counters, or self-service check-in kiosks, and in some
cases can be printed from airline Web sites. Ask your travel agent for the
latest regulations.

Watch your belongings. Keep your luggage and carry-on
luggage with you at all times prior to arriving at the airport and while in the
terminal.
·
Packing “do’s and don’ts.” Do carry medications in your
carry-on bags. Don’t accept any packages or materials from strangers or carry
any sharp instruments (i.e., letter openers, knives, box cutters, scissors,
etc,) in carry on luggage. They will be confiscated at airport screening

Group travel tips. If you are traveling with a tour group
or cruise group, you may encounter special security procedures. Please ask your
travel agent or tour operator for more information.
·
Report suspicious behavior. If you see any suspicious
activity or see unattended bags, contact airline or airport personnel
immediately.
At your destination …
·
Know your surroundings. Learn the location of stairways,
fire escapes, exits and alarms.
·
Dress comfortably and inconspicuously. Don’t draw attention
to yourself by displaying large amounts of cash or wearing expensive-looking
jewelry.
·
Get your things. When deplaning, claim your baggage
immediately and leave the airport quickly.
·
Don’t panic. If you find yourself near a civil disturbance
or other dangerous situation, move away quietly and inconspicuously. Do not
run. If this is not possible, take cover behind the nearest shelter and stay
there until danger passes.
·
Carry a cell phone. If you have a cell phone, carry it. If
you’ll be traveling abroad, talk to your travel agent about renting a universal
cell phone that works overseas.
